轻罪治理背景下增设社会服务刑研究

Research on the Addition of Social Service Penalty under the Background of Misdemeanor Governance

刑事立法和犯罪态势的变化,需要治理方法和治理手段及时调整。创设新型的轻刑是轻罪治理的一个重要策略。通过考察域外立法经验,结合我国的实际情况,有必要增设社会服务刑这种轻刑。增设社会服务刑是应对犯罪圈扩张的需要,是构建合理的刑罚结构的需要,是行刑社会化的需要。从可行性的角度考虑,现有的社区矫正制度和曾经试点的社会服务令为增设社会服务刑提供了现实土壤和实践基础,国外社会服务刑的立法为我国增设社会服务刑提供了可供参考的经验。因此,社会服务刑作为一种极具潜力和生命力的非监禁刑,完全有必要纳入我国的刑罚体系,就社会服务刑的性质而言,应当将其定位为主刑的一种,主要适用于轻罪。

The change of criminal legislation and criminal situation requires adjustment of governance methods and means.Creating a new type of light punishment is an important strategy for misdemeanor management.It is necessary to add the light penalty of social service penalty by investigating the experience of foreign legislation and combining the actual situation of our country.The addition of social service penalty is the need to cope with the expansion of the criminal circle,to build a reasonable penalty structure,and to socialize the execution of punishment.From the perspective of feasibility,the existing community correction system and the pilot social service order provide the practical soil and foundation for the addition of social service penalty.The legislation of social service penalty in foreign countries provides reference experience.Therefore,as a kind of non-imprisonment penalty which has great potential and vitality,it is completely necessary to bring social service penalty into our penalty system.As far as the nature of social service penalty is concerned,it should be positioned as one of the main penalty,which is mainly applicable to misdemeanors.
