我国已经进入法典化时代。《民法典》把“人格权”独立成编,确立“隐私权”概念、明晰“隐私权保护优先”原则、实施“人格权禁令”制度,规定法律和习惯是规范性法源等。所有这些新理念、新举措以“典”的存在形式,增强了“以人为本、立法为民”的立法价值观,强化了法律对公民个人隐私与个人信息保护的力度,彰显了《民法典》“规范公权力,保护私权利”的现代法治核心理念。个人隐私是法律确认的独立人格权,《民法典》对公民隐私权、个人信息权进行了法律规制,各级政府制定了保护公民隐私权的法规规制,司法机关确立了信息公开中隐私权和个人信息权的保护原则,立法机关对数字化时代隐私权保护规则予以修订重塑。

China has entered the codification era.Personality right has become an independent part of the Civil Code.The Civil Code also establishes the concept of “right of privacy”,clarifies the principle of “priority of privacy protection”,establishes the system of “prohibition of personality right”,and stipulates that law and custom are the source of normative law.All these new concepts and measures,in the form of the existence of the code,strengthen the legislative values of “people-oriented,legislation for the people”,strengthen the protection of citizens' personal privacy and personal information by law,and highlight the core concept of modern rule of law in the Civil Code of “regulating public power and protecting private rights”.Privacy is an independent personality right of legal confirmation,the Civil Code regulates citizens' right to privacy and personal information,governments at all levels have formulated laws and regulations to protect citizens' privacy rights,judicial organs have established the protection principles of privacy rights and personal information rights in information disclosure,and legislative organs have revised and reshaped the privacy protection rules in the digital era.
