摘要
伴随数字技术进步而兴起的网络短视频已打破了创作者与受众之间的二元模式界限。二次创作短视频作为短视频的重要类型,在数量日益增长的同时,也因创作过程对原作品的利用和传播而与著作权人产生了权利冲突;而且由于二次创作短视频在分类上的不确定性,导致了对其规制缺乏针对性,进而加深了视频创作者与著作权人的矛盾。这些问题不仅造成了相关创造者著作权受损,更给二次创作短视频的健康发展带来较大阻碍。只有对二次创作短视频的独创性加以分析,依据创新程度厘定其类别并设置相应的侵权规制路径,才能使著作权得到充分行使的同时,保障社会公众参与文化活动的正当权利,形成新的利益平衡。
The rise of online short videos,driven by advancements in digital technology,has shattered the binary boundaries between creators and audiences.Remixed short videos,as an important genre within short videos,have experienced significant growth in quantity.However,conflicts arise between creators of remix short videos and copyright holders due to the utilization and dissemination of original works during the creative process.Moreover,the lack of clear classification for remixed short videos has led to a lack of targeted regulation,exacerbating the tensions between video creators and copyright hold⁃ers.These issues not only harm the rights of relevant creators but also hinder the healthy development of remixing short videos.To address these challenges,it is necessary to analyze the originality of remixed short videos,categorize them based on the degree of creativity,and establish appropriate paths for copy⁃right regulation.Only by doing so can copyright be fully exercised while safeguarding the legitimate rights of the public to participate in cultural activities and achieving a new balance of interests.
