摘要
根据目前我国出台的《中华人民共和国民法典》《中华人民共和国个人信息保护法》对敏感个人信息保护的相关规定,提出了在数据共享下敏感个人信息保护的法律原则、判定标准、知情同意和精神损害赔偿方面的四个法律问题。通过对欧盟《通用数据保护条例》《德国联邦数据保护法》和美国相关立法的借鉴,从完善法律规范、政府监督和行业自律三个角度对我国敏感个人信息保护提出了建议。
According to the relevant provisions on the protection of sensitive personal information in the Civil Code of the People’s Republic of China and Personal Information Protection Law of the People’s Republic of China,four legal issues are put forward on the protection of sensitive personal information in the context of data sharing,including legal principles,criteria,informed consent and compensation for mental damage.Suggestions are made from three perspectives of improving legal norms,government supervision and industry self-discipline by drawing on the European Union’s General Data Protection Regulation,German’s Federal Data Protection Act and relevant laws from the USA.
