摘要
我国物流行业虽持续蓬勃发展,但面对增量巨大的物流业务,物品丢失甚至损毁的现象屡见不鲜,损害了消费者的合法权益。关于物流损害赔偿问题,实践中存在诸多困境,问题集中在物流损害赔偿归责原则模糊、快件保价制度不合理、未保价快件损害赔偿数额较低、快件损害赔偿范围不具体以及物流服务合同中免责条款过多等。鉴于此,针对上述问题文章分别提出了完善建议,以期促进我国物流服务行业的规范化发展。
Although the logistics industry continues to develop vigorously,the phenomenon that items have been lost and even damaged is not uncommon,which harms the legal rights and interests of consumers,in the face of the incremental logistics business.There are many difficulties in the practice of logistics damage compensation.The problems focus on the fuzzy principle of liability for logistics damage compensation,unreasonable insurance system for express goods,low amount of damage compensation for uninsured express goods,unspecific scope of damage compensation for express goods and too many exemption clauses in the logistics service contract.In view of this,some suggestions are put forward to improve the logistics service industrys.
