数字时代下,数据跨境流动规模巨大。在刑事司法领域,为实现追诉目的,亦有从他国调取刑事数据的需求,从而形成刑事数据出入境的问题。其中刑事数据出境对数据存储国影响重大,为防控风险,应对出境刑事数据进行安全评估。刑事数据出境安全评估应以维护国家主权、保障数据安全、兼顾现实性和前瞻性为基本理念,明确安全评估的主管部门、申报主体和其他利益相关方,并确定安全评估的对象、方式、内容要点、以及未通过安全评估的处理与救济机制,从而构建起我国的刑事数据出境安全评估制度基本框架,以促进刑事数据的安全、有序出境,满足国际刑事司法协助的需求。

In the digital age,data flows cross-border on a huge scale.In the field of criminal justice,in order to achieve the purpose of criminal pursuit,there is also a need to obtain criminal data from other countries,thus forming the issue of the import and export of criminal data.Among them,the export of criminal data has a significant impact on the country where the data is stored.In order to prevent and control risks,a security assessment for criminal data export should be conducted.The security assessment for criminal data export should be based on the basic concept of safeguarding national sovereignty,ensuring data security,and taking into account reality and forward-looking.By clarifying the competent authorities,reporting entities and other stakeholders of the security assessment,as well as determining the objects,methods and content of the security assessment,and the processing and remedy mechanism for those who fail the security assessment,the basic framework of China's security assessment system for criminal data export can be established to promote the safe and orderly export of criminal data and to meet the needs of international criminal judicial assistance.
