我国政府购买养老服务的监督法律关系

The supervision and legal relations of government's purchase of elderly care services in China

随着人口老龄化趋势加重,我国政府购买养老服务也在不断推进,各级财政部门在购买养老服务上拨付的资金越来越多,但由于缺乏完善的监督,服务质量却参差不齐。由于政府购买养老服务涉及政府、承接服务方、被服务方这三方,为加强监督,提高政府购买养老服务的质量,首先需厘清三者之间的监督法律关系。在分析政府购买养老服务的法律属性的基础上进一步探讨所涉三方的监督关系,以期为法律的完善及实务提供理论基础。

With the continuous advancement of the purchase of elderly care services by the government,financial departments at all levels have allocated more and more funds for the purchase of elderly care services.But due to the lack of perfect supervision,the service quality is not satisfactory.Since the government purchase of elderly care services involves the tripartite relationship between the government,the service provider and the serviced party,the composition of the supervision legal relationship has become the first problem to be solved.On the basis of clarifying the legal nature of the government's purchase of elderly care services,this paper further explored the supervision relationship of the three parties involved,in order to provide a theoretical basis for the improvement of the law and practice.
