Research on the development and legal issues of"Internet+Traditional Chinese Medicine"service model

在人口老龄化和新冠疫情常态化的社会背景下,“互联网+中医药”的作用日益凸显,不断完善我国政策及法律法规对该产业的发展有着重要意义。但我国“互联网+中医药”仍存在诸多法律困境,如中药材质量、人员监管、个人信息及互联网医疗的局限等。因此,探讨通过推行国家中医药质量标准、多方协同的监管机制、阶梯式个人信息保护以及互联网诊疗范围的拓宽等方式,为借助互联网优化配置中医药资源及完善和健全国家相关立法提供参考。

Under the social background of the aging population and the normalization of COVID-19,the role of"Internet+Traditional Chinese Medicine"has become increasingly prominent,and it is of great significance for the development of this industry to constantly improve China's policies,laws and regulations.However,there are still many legal dilemmas in"Internet+Traditional Chinese Medicine",such as the quality of Chinese medicinal materials,personnel supervision,personal information and limitations of Internet medical care.Therefore,this paper suggests implementing the national quality standard of Traditional Chinese Medicine,multi-party cooperative supervision mechanism,stepped personal information protection,and widening the scope of Internet diagnosis and treatment,to provide reference for optimizing the allocation of Traditional Chinese Medicine resources with the Internet and improving the relevant national legislation.
