自媒体“洗稿”屡禁不绝,可著作权制度中对与其密切相关的“剽窃”“独创性”“单纯事实消息”等核心概念缺少界定,法规抽象笼统,著作权人举证艰难、诉讼追偿得不偿失,司法流程复杂,判定标准不清,以致依法治理遭遇定性难、维权难和裁量难。纾解法治难题,有必要完善法律法规,明晰核心概念和认定界限;发挥著作权集体管理机构的作用,加大维权技术支持力度和侵权违法成本;优化司法流程,诉讼与非诉讼、线上与线下并行,强化法治的同时推进德治,逐步形成德法兼治的“洗稿”治理模式。
