摘要
在数字经济领域,“相关市场”的界定是反垄断执法中的难点,关乎执法效果。针对理论和实践中存在的对数字经济领域“相关市场”界定的地位、维度、方法等争论,认为“相关市场”界定的地位问题:垄断协议案件和经营者集中案件原则上可以不界定相关市场,但滥用市场支配地位案件原则上需要界定相关市场。“相关市场”界定的维度问题:根据维度的选择必须遵循必要的最近原则,盈利来源、平台类型、注意力等不可作为独立的维度,但是它们应当成为商品维度的重要权衡因素。“相关市场”界定的方法问题:当所涉的具体情形存有可用的价格信息时,应当优先考虑SSNIP测试法;当所涉的具体情形没有可用的价格信息,但所涉的具体情形有关非价格的内容可以进行量化时,应当优先考虑SSNDQ测试法;当所涉的具体情形没有可用的价格信息,而且所涉的具体情形有关非价格的内容难以进行量化时,可考虑一般的定性分析方法。
For the status of defining the relevant market in the field of digital economy:in principle,monopoly agreement cases and undertaking concentration cases may not define the relevant market while cases of abusing dominant market position need to define the relevant market.For the dimensions of defining relevant markets in the field of digital economy:according to the selection of dimensions,the necessary nearest principle must be followed.Profit sources,platform types and attention can not be regarded as independent dimensions,but they should become important trade-offs of commodity dimension.For the method of defining the relevant market in the field of digital economy:when the specific situation involved has available price information,priority should be given to the SSNIP test method;when there is no price information available for the specific situation involved,but the non-price content of the specific situation involved can be quantified,SSNDQ test method shall be given priority;when there is no price information available for the specific situation,and the non-price content of the specific situation is difficult to quantify,the general qualitative analysis method can be considered.
