The Logical Justification of the Settlement Mechanism of Administrative Cases Intersected with Civil Cases

源于对行政审判实践中“循环诉讼”“程序空转”现象的反思,2014年《中华人民共和国行政诉讼法》修订时建立了行政诉讼一并审理民事争议制度,以此解决行民交叉案件,该制度的建立具有一定的必然性。从现实逻辑看,该制度将当事人诉求作为审查起点、拓宽了司法审查深度、有效保障当事人的诉权,是对实质性解决行政争议理念的积极回应。从理论逻辑看,行政行为对民事审判的拘束作用致使特定行民交叉案件只能通过行政诉讼一并审理民事争议程序解决。从实践逻辑看,在公私法相互渗透的背景下,行政法律关系与民事法律关系产生大量的交织,该制度为融合两种不同性质的诉搭起“桥梁”,督促法官确立“整体法学”观,在诉讼过程中灵活运用行政法律规范与民事法律规范,平衡公益与私益。

Due to the reflection on the phenomenon of"circular litigation"and"procedural idleness"in the practice of administrative trial,the Administrative Litigation Law of the People's Republic of China was revised in 2014 to establish the system of simultaneous trial of civil disputes in administrative litigation in order to settle administrative cases intersected with civil cases and the establishment of this system has a certain inevitability.From the perspective of realistic logic,the system takes the demands of the parties as the starting point of examination,broadens the depth of judicial review,and effectively protects the litigation rights of the parties,which is a positive response to the concept of substantive settlement of administrative disputes.From the perspective of theoretical logic,due to the binding effect of administrative acts on civil trials,specific cross-cases can only be resolved through administrative litigation and civil dispute procedures together.From the perspective of practical logic,under the background of mutual penetration of public and private laws,administrative legal relations and civil legal relations are intertwined.This system sets up a"bridge"for the integration of two different kinds of lawsuits,urges judges to establish a"holistic law"view,fexibly uses administrative legal norms and civil legal norms in the litigation process,and balances public and private interests.
