摘要
预防性法律制度下的“枫桥经验”具有鲜明的时代特征。“枫桥经验”体现更多法治属性:讲法说理进一步强化,法律权威得到体现。体现更多可实施性:“枫桥经验”的可接受性和可操作性得以提高。预防性法律制度下新时代“枫桥经验”展现三个发展方向:一是预防为主得到更加鲜明的彰显;二是“枫桥经验”的规范性、确定性得到进一步提升;三是“枫桥经验”的权威性得到增强。
The“Fengqiao Experience”(a model of grassroots governance with Chinese characteristics regarded as the bench-mark for resolving social disputes)under the preventive legal system has distinct characteristics of the times.The“Fengqiao Ex-perience”embodies more legal attributes,which conduces to further strengthening legal reasoning and legal authority.The“Fengqiao Experience”also puts a premium on its implementability as it has improved its acceptability and operability.Under the preventive legal system,the“Fengqiao Experience”in the New Era presents three development directions.Firstly,the policy of putting prevention first in legal work is highlighted more clearly;secondly,the standardization and certainty of the“Fengqiao Ex-perience”are further enhanced;and thirdly,the authority of the“Fengqiao Experience”becomes solidly established.
