警察搜查物联网智能设备的法律规制

案发现场的智能设备可能会记录违法犯罪信息,在被公安机关获取后,可能作为证据,成为定罪量刑的依据。物联网智能设备的搜查应该做到:物联网智能设备与正在查处的案件相关;如果有其他证据能够证明违法或犯罪行为时,一般不得搜查物联网智能设备中的隐私信息;搜查物联网隐私信息应该获得当事人的同意或获得搜查证;“功能简单、存储信息少”的智能设备,可以无证搜查;如果该智能设备中存储的信息涉及重大犯罪行为,不立即搜查将危及国家安全和人民的生命安全时,可先行搜查,然后再补办搜查证;在没有合理事由的情形下,违反上述原则搜查物联网智能设备,给当事人的隐私造成重大损害,并可能严重影响司法公正的,应该对有关证据应当予以排除。

The smart device at the crime scene may record illegal and criminal information,and after being obtained by the public security organs,it may be used as evidence and become the basis for conviction and sentencing.The search of intelligent devices of the Internet of things should be:intelligent devices of the Internet of things are related to the case being investigated;If there is other evidence that can prove illegal or criminal acts,generally do not search the privacy information in the intelligent devices of the Internet of things;Searching the privacy information of the Internet of things should obtain the consent of the parties or obtain a search warrant;Intelligent devices with"simple functions and less stored information"can be searched without a warrant;If the information stored in the intelligent device involves a major crime,and the national security and people's life safety will be endangered,if it is not searched immediately,the search can be conducted first,and then the search warrant can be reissued;In the absence of reasonable reasons,if the search of intelligent devices of the Internet of things in violation of the above principles causes significant damage to the privacy of the parties and may seriously affect judicial justice,the relevant evidence shall be excluded.
