大数据法律监督赋能行刑衔接工作路径研究

Research on the Work Path of Big Data Legal Supervision Empowerment and Execution Connection

检察工作现代化的根本是法律监督的现代化,而大数据技术在其中发挥着重要作用。囿于数据来源途径较少、分析研判能力有限、制度落实不到位等因素,传统的行政执法与刑事司法之间的双向衔接工作存在脱节和漏洞。应充分利用检察机关的内生数据和外部数据,在行刑衔接工作的正向衔接和反向衔接中分别建立大数据法律监督模型,通过数据比对碰撞发现监督线索,实现对行刑衔接工作的双向监督,减少“以罚代刑”“不刑不罚”的情况,提高检察机关对行刑衔接工作的法律监督效能。

The fundamental modernization of procuratorial work is the modernization of legal supervision,and the application of big data is very important.Traditional execution connection work is limited by factors such as limited data sources,limited analysis and judgment capabilities,and inadequate institutional implementation,resulting in disconnection and loopholes between administrative law enforcement and criminal justice.This article aims to explore the feasibility path of applying the big data legal supervision model to the execution linkage work,fully utilizing the endogenous and external data of the procuratorial organs,and establishing big data legal supervision models in the forward and reverse linkage,respectively.Through data comparison and collision,supervision clues are discovered to achieve two-way supervision of the execution linkage work,reducing the occurrence of"punishment instead of punishment"and"no punishment without punishment",improving the effectiveness of procuratorial organs in connecting legal supervision with execution.
