在航行中未开启自动识别系统的罚则适用研究

Study on the Application of Penalties for Failure to Turn on AIS During Navigation

《中华人民共和国海上交通安全法》自2021年9月1日施行以来,业界对于其中船舶未开启自动识别系统的处罚条款存在一些争议,实践中也有不同做法。通过分析《中华人民共和国海上交通安全法》修订前后的处罚条款,对几种涉及船舶未开启自动识别系统的海事行政处罚做法进行评析,并针对该海事行政处罚遇到的问题提出工作建议。

Since the Maritime Traffic Law of the People’s Republic of China came into force on September 1,2021,there have been disputes in the industry over the application of punishment clauses for vessels failing to turn on its automatic identification system(AIS)as well as controversial practices.Comparison of the new version on penalty clauses of the Maritime Traffic Safety Law with those of previous one,this paper evaluates the several categories of maritime administrative punishment practices involving vessels failing to turn on its AIS,and puts forward suggestions in view of the problems encountered in the maritime administrative punishment.
