摘要
针对当前国际海运与国际贸易实务中非清洁提单运用的困境,依据信用证存在的独立性原则与抽象性原则,提出使用赔偿责任书是处理非清洁提单的重要方式。针对赔偿责任书使用中存在的争议,发现要求船公司在接受赔偿责任书时取得买方的同意,同时在海运提单上对赔偿责任书的使用作出备注,在国际航运与国际贸易实务中是可行的方法。
ion of letters of credit,we proposed that the letter of indemnity is an important way to solve the issues with the application of dirty bills of lading.Finally,in view of the controversies in the use of the letter of indemnity,we found that the shipping company and the seller should obtain the buyer's consent before using the letter of indemnity,and at the same time,a special note should be included in the marine bill of lading pertaining to the use of the letter of indemnity to avoid possible damage to the goodwill of the shipping company.
