国际金融中心司法制度研究——以阿斯塔纳国际金融中心法院为视角

Study on Judicial System of International Financial Center——A Case Study of Astana International Financial Center Court

国际金融中心的建设和发展离不开司法的保障。哈萨克斯坦为建设阿斯塔纳国际金融中心,在中心内成立阿斯塔纳国际金融中心法院。其是中亚地区第一个基于英国法律规范和原则构建的普通法系法院,制度设计具有独立性、灵活性、可预测性等特征。国际金融中心司法机构的设置应当具有必要性,其必要性评判应考量国家战略需要、争议解决的便捷性、未来争议解决的市场需求度等因素;应当在国内法中明确国际金融中心司法机构的主体地位;应当为国际金融中心司法机构所作裁决提供承认和执行的保障;注重国际金融中心内多元化争议解决机制之间的协同发展与良性互动。

The construction and development of the international financial center cannot be separated from the judicial guarantee.In order to build the Astana International Financial Center,Kazakhstan established the Astana International Financial Center Court in the center.It is the first common law court in Central Asia based on British legal norms and principles,and its system design is characterized by independence,flexibility and predict‐ability.The establishment of the judicial institution of the international financial center should be necessary,and its necessity evaluation should take into account the national strategic needs,the convenience of dispute resolution,the market demand for future dispute resolution and other factors.The subject status of the judicial institu‐tion of the international financial center should be clarified in the domestic law;Guarantees should be provid‐ed for the recognition and enforcement of decisions made by the judicial bodies of international financial centres;Focus on the coordinated development and positive interaction between the diversified dispute resolution mecha‐nisms in the international financial center.
