同理心正义视域下严格执法的困境与优化路径

推进全面依法治国,必须坚持严格执法。在严格执法过程中,需要将法治的力度和温度有效地结合起来,彰显社会公平正义。特别是对社会弱势者要秉持一定的同理心,将同理心正义融入严格执法之中。严格执法与同理心正义密切相关,同理心正义是严格执法的应有之义,严格执法是同理心正义的基础和前提。严格执法过程中同理心正义的缺乏,主要原因在于执法者并未完全坚持以人民为中心的理念、执法者的自身局限、执法方式的不规范性等。要消解执法过程中同理心正义缺失的问题,需要坚持以人民为中心的执法理念、加强执法队伍建设、不断创新执法方式。严格执法中嵌入同理心正义,让人民群众在每一个执法决定中感受到公平正义,是法治政府建设的重要内容与核心要义。

To promote the comprehensive rule of law,we must adhere to strict law enforcement.In the process of strict law enforcement,it is necessary to effectively combine the strength and temperature of the rule of law to demonstrate social fairness and justice.In particular,the disadvantaged in society should be integrated with empathy and justice into strict law enforcement.Strict law enforcement is closely related to empathy and justice.Empathy and justice is the due meaning of strict law enforcement,and strict law enforcement is the basis and premise of empathy and justice.The main reason for the lack of empathy and justice in the process of strict law enforcement is that the law enforcement does not fully adhere to the people-centered concept,the limitations of the law enforcement,and the law enforcement methods of law enforcement.To eliminate the problem of lack of empathy in the process of law enforcement,we need to adhere to the people-centered law enforcement concept,strengthen the construction of law enforcement teams,and constantly innovate law enforcement methods.Empathy and justice are embedded in strict law enforcement,and making the people feel fairness and justice in every law enforcement decision is an important content and core essence of the building of a law-based government.
