“三权分置”下宅基地使用权利用主体多元化的路径探索

Exploring the Diversified Path of the Subject of Homestead Use Rights under the“Three Rights Separation”

随着“三权分置”改革的不断深入和城乡融合的进一步发展,农村宅基地资源的开发利用是当前土地制度改革的关键。但宅基地使用权所具有的身份性使其流转受到极大的限制,致使宅基地被大量闲置和浪费,也难以解决“一户多宅”的问题。引入多元主体共同开发利用农村宅基地资源,构建新型宅基地盘活利用主体结构,应当完全放开宅基地使用权受让主体范围,拓展宅基地流转方式及多主体利用,健全宅基地退出机制和流转交易市场建设,完善宅基地经营性用途和利益分配机制,才能促进农村宅基地资源的有效利用,助力农村共同富裕和乡村全面振兴。

With the continuous progression of the“three rights separation”i.e.the separation of ownership,contract right and right of management,and the further development of urban-rural integration,the exploration and utilization of rural homestead resources becomes the key to the current land system reform.However,the identity of the right to use homestead land greatly restricts its cir⁃culation,resulting in a large amount of idle and wasted homestead land,and making it difficult to solve the problem of"one house⁃hold with multiple homesteads".In order to Introduce multiple entities to jointly develop and utilize rural homestead resources,con⁃struct a new structure of active utilization of homestead land,we should fully open up the scope of the homestead land use rights,expand the methods of homestead land transfer and multi entity utilization,improve the exit mechanism and transaction market con⁃struction of homestead land,improve the operational use and benefit distribution mechanism of homestead land.With all above measures,we can promote the effective utilization of rural homestead resources and achieve rural common prosperity and all-round rural revitalization.
