论追诉时效的几个问题

On Several Problems Concerning the Statute of Limitations of Prosecution

追诉时效是刑法中的一项重要制度,其主旨是犯罪实施后经过一定时期不再追诉。但因刑法中规定了追诉时效延长的例外,在扫黑除恶专项行动中,多年前所犯罪行往往被作为黑恶势力犯罪一并予以追诉。因此有必要深入研究追诉时效制度特别是刑法关于延长追诉期限的规定,正确理解追诉时效制度的精神,以便更好地发挥追诉时效制度的作用。本文在论证追诉时效制度设置的基本精神的基础上,辨析了追诉的基本含义,并结合司法实践对延长追诉期限的各种例外情况进行了具体的分析论述。

The statute of limitations of prosecution is an important part in the criminal law,and its main idea is that a given crime will not be prosecuted after a certain period of time.However,due to the exception to the extension of the statute of limitations of prosecution provided in the criminal law,in the special operation to crackdown on gang crimes,crimes committed many years ago are often prosecuted as gangsters'crimes together.Therefore,it is necessary to deeply study the mechanism of the statute of limitations of prosecution,especially the provisions of the criminal law on extending the time limit of prosecution,and correctly understand its spirit so as to better play the role of the statute of limitations of prosecution.On the basis of demonstrating the basic spirit for setting up the limitation of the prosecution system,this paper analyzes the basic meaning of prosecution,and makes a specific analysis of various exceptions to the extension of the limitation of prosecution in combination with judicial practice.
