生态环境损害赔偿诉讼和检察公益诉讼有着共同的制度目标和不同的制度设计,对于如何处理二者之间的关系,实务界的做法并不统一。立足于检察机关的法律监督职能,从法律监督的视角重新审视两种诉讼制度之间的衔接关系,不难发现适用范围不明引发制度分工失序、多重角色矛盾冲突造成监督障碍、信息不充分引致的形式化监督效果不佳等诸多问题。对此,应当在厘清制度性质的基础上确定制度竞合规则,构建多种角色功能定位与转换机制,建立健全信息共享与多重监督机制,以确保顺畅衔接,产生“1+1>2”的效用。

The ecological environment damage compensation litigation and public interest prosecu-tion litigation share common institutional goals and different institutional designs,and there is no unified approach in the practical field on how to handle the relationship between the two.Based on the legal supervision function of the procuratorial organs,it is not difficult to re-examine the con-nection between the two litigation systems from the perspective of legal supervision.It is not diffi-cult to find many problems such as unclear scope of application leading to disordered division of labor in the system,multiple role conflicts causing supervision obstacles,insufficient information leading to poor formal supervision effect.In this regard,based on clarifying the nature of the sys-tem,it is necessary to determine the rules for institutional competition and cooperation,establish a mechanism for the positioning and transformation of multiple roles and functions,establish and im-prove information sharing and multiple supervision mechanisms,to ensure smooth connection and generate a"1+1>2"effect.
