摘要
互联网弹窗“乱弹”是群众反映强烈、影响上网体验的网络生态乱象之一。2022年9月30日《互联网弹窗信息推送服务管理规定》施行后,互联网弹窗乱象一定程度上得到了遏制,但通过行政手段进行的整治威慑力远远低于诉讼。因此文章从实证角度出发,通过对湖北省消费者协会、河北省人民检察院等地进行访谈,在整理现有法规政策和典型案例的基础上,就证据收集、诉讼请求、责任主体、违法标准等方面实地调研访谈,更进一步地探究网络弹窗公益诉讼现有困境及优化路径。
Internet pop-up window“random bomb”is one of the chaos of the network ecology that has a strong reaction from the masses and affects the online experience.After the implementation of the Provisions on the Administration of Internet Pop-up Information Push Services on September 30,2022,the chaos of Internet pop-ups have been curbed to a certain extent,but the deterrent effect of rectification through administrative means is far lower than that of litigation.Therefore,from an empirical point of view,this paper further explores the existing difficulties and optimization paths of online pop-up public interest litigation on the basis of conducting interviews at Hubei Provincial Consumer Association,Hebei Provincial People s Procuratorate and other places,collating existing laws and regulations and typical cases,and conducting on-site research and interviews on evidence collection,litigation claims,responsible subjects,illegal standards,etc.
