农村环境治理司法保障路径探析——以雅安市为例

Analysis on the Judicial Guarantee Path of Rural Environmental Governance——Taking Ya'an City as a Case

乡村环境治理与民生福祉息息相关,妥善解决环境治理纠纷是推动美丽乡村建设的基础,亦是实现乡村治理现代化的必由之路。司法作为解决乡村环境治理纠纷的最后一道防线,理应发挥保障功能。以雅安市为例,剖析乡村环境治理司法保障方面存在的问题,总结出当前仍存在乡村环境法律规范不完善、司法制度仍未建立、司法组织建设较为薄弱等问题。从完善实体法律依据、设立多元主体参与机制、提升司法主体参与意识和能力、完善基层环境司法队伍建设、健全司法专门化和巡回化体系、创新环境司法责任追究制度等方面,提出完善乡村环境治理司法保障体系的路径。

Rural environmental governance is closely related to the well-being of the people.The proper resolution of environmental governance disputes is the basis for promoting the construction of beautiful villages and the only way to realize the modernization of rural governance.Justice,as the last line of defense to solve rural environmental governance disputes,should play its safeguard function.Taking Ya'an City as an example,this paper analyzes the problems in the judicial guarantee of rural environmental governance,and concludes that there are still some problems such as the imperfect legal norms of rural environment,the lack of judicial system and the weakness of judicial organization construction.This paper proposes paths to improve the judicial guarantee system of rural environmental governance from perfecting the legal basis of entities,establishing the participation mechanism of multiple subjects,raising the awareness and ability of judicial subjects to participate,improving the construction of the environmental justice team at the grass-roots unit,perfecting the system of judicial specialization and circuit,and innovating the system of environmental judicial accountability.
