摘要
我国积极探索推进数据要素市场化,加快构建以数据为关键要素的数字经济,围绕数据资源开发利用的法律制度体系建设取得了积极进展,形成了覆盖关键环节的体系框架及关键要求。随着我国数据要素市场化进程进一步走深走实,与国际数据治理规则竞争进一步加剧,现有的数据资源开发利用立法在支撑全国统一数据市场建设,以及引导、规范开发利用活动方面存在不足,应在数据基础设施、数据供给、数据流通、数据应用创新及数据跨境流动等关键环节进行立法完善。
China actively promotes the marketization of data elements and accelerates the construction of a digital economy with data as the key element.A preliminary legal system has been established for the development and utilization of data resources.This legal system covers key data links and proposes key requirements.With the development of the data element market,China participates in the international competition of of data rules.However,the existing data legal system cannot support the development and utilization of data and is also insufficient to meet the development of a unified national data market.Based on the theoretical research and practical needs,this study concludes with proposals to solve the improvement of legislation problems of data infrastructure,data supply,data circulation,data application and innovation,data cross-border flow.
