企业合规不起诉制度公检衔接问题研究

Research on the Connection Between the Police and the Procuratorate in the Compliance Non-prosecution System of Enterprises

公安机关对涉罪企业采取的各类强制性侦查措施,使得涉罪企业的经营状况在启用合规不起诉程序之前便受到影响,从而失去了适用该制度的能力。为解决该问题,一方面,需要通过公安机关内部对企业犯罪案件处理制度的改革,使其采取的侦查措施轻缓化,并且协同第三方组织将合规甄别程序提前至侦查阶段;另一方面,检察机关需要通过严控审查批捕、提前介入侦查等方式,在监督公安机关的同时,协助其完成对企业犯罪案件的甄别与侦查,并据此适当提前启动企业合规不起诉制度。

All kinds of mandatory investigation measures taken by the public security organs against the enterprises involved in the crime have affected the operation of the enterprises before the compliance nonprosecution procedure is started,thus losing the ability to apply the system.To solve this problem,on the one hand,it is necessary to reform the internal system of public security organs to deal with corporate crime cases,so that their investigation measures can be eased,and then cooperate with the third-party organizations to advance the compliance screening procedure to the investigation stage;on the other hand,the procuratorial organs need to help them complete the screening and investigation of corporate crime cases while supervising the public security organs by strictly controlling the review and approval of arrests,early intervention in investigation in advance,etc.in order to properly start the enterprise compliance non-prosecution system in advance.
