历史文化名城保护立法的责-权-利关系研究——以《泉州市历史文化名城保护条例》制定为例

The Research of Responsibility-Power-Interest Relationship in the Legislation on Historic and Cultural City Conservation:An Example of the Ordinance Formulation on Quanzhou Historic and Cultural City Conservation

历史文化名城保护条例是承接上级法律法规要求、指导地方名城保护工作的重要保障。中国名城保护已进入多方参与、推进实施的关键阶段,明确保护主体的责-权-利关系,并据此推进历史文化名城立法工作,将有助于多元主体有效参与名城保护与管理。为此,首先辨析名城保护主体与保护对象的构成要素,构建名城保护立法的责-权-利关系框架,明确不同保护对象的保护责任,强化多元主体参与保护与管理工作的权力控制,加强社会、经济、文化等全方位的多元主体利益保障,并结合地方遗产价值特色明晰保护原则与方法指导。进而,以泉州为例,通过责任划分、权力控制、利益保障、泉州特色4个部分的讨论,开展责-权-利关系清晰、互相促进的历史文化名城保护立法实践。

Ordinance on historic and cultural city conservation at the city level is the significant guarantee to implement the superior laws and guide the local urban conservation practices.As the historic and cultural city conservation in China has entered the pivotal stage of multi-participation and implementation,it is important to perfect the relevant legislation on the basis of specific and balanced responsibility-power-interest relationship of multi-participants,in order to constrain and guide multi—participants to effectively participate in historic and cultural city conservation and management.Therefore,the research firstly discriminates the historic and cultural city conservation stakeholders and objects,and constructs the responsibility-power-interest relationship framework,which requires to clarify the conservation responsibilities of different conservation objects,reinforce the power control of multi-participants,strengthen the social,economic,cultural interests guarantee of multi-participants,and illustrate the conservation principle and method based on local heritage characteristics.Then,the research formulates the ordinance on Quanzhou historic and cultural city conservation through the discussion of responsibility division,power control,interest guarantee and local characteristics analysis.
