The Possibility in the Victim’s Fault Liability in Civil Compensation of Telecom Network Fraud

被害人过错责任是犯罪学领域讨论的范畴。以电信网络诈骗中被害人存在谨慎义务为前提,从谨慎义务的来源、经济分析与规范分析来认识被害人过错责任。被害人过错责任从应然—实然、立法—司法的两个维度加以理解。被害人加权责任深化了被害人过错责任理论的目的,由此建构起电信网络诈骗中可能的责任区分。

Victim fault liability is a topic in the fi eld of criminology.Based on the premise that victims have a duty of care in telecom network fraud,this paper discusses the victim’s fault liability from the source,economic analysis and normative analysis of the duty of care.The victim’s fault liability should be understood from the two dimensions regarding should-actual and legislative-judicial.The victim’s weighted responsibility deepens the purpose of the theory of victim fault liability,thereby constructing the possible liability distinction in telecom network fraud.
