作为教学方法的请求权基础分析法:澄清误解与展望未来

摘要 请求权基础分析法主导的案例教学在逐步推广的同时也引发了诸多质疑。针对该方法处理范围有限、分析视角单一的质疑实则是误解,法典完备与否和教义学的发展情况并不能用来评价该方法的价值。在相关教学改革中,除了更为全面地引入类似课程,还需要注意提升民法基础课程的质量。有意开设类似课程的院校应充分利用现有资源并尝试建立助教培养机制以实现可持续发展。 Case analysis courses led by the gradually widespread analysis method of claim basis have raised many doubts.Doubts on the perspective and its limited application are misconceptions in fact because the completeness of the code and the development of dogmatics are not eligible to be used to evaluate the method.In addition to the more comprehensive introduction of similar courses as a companion to lectures,future reform needs to pay more attention to the quality of rudimentary courses of civil law.Schools wishing to offer such courses should make full use of existing resources and try to establish an internal mechanism for the training of teaching assistantsto achieve sustainable development.
