数智时代法律硕士研究生特色课程体系建设研究

Research on the Construction of Characteristic Curriculum System for Master of Law Postgraduates in the Era of Digital Intelligence

特色课程体系建设是数智时代提升和保障法律硕士研究生教育质量的关键举措,是满足数智时代复合型法律人才的重要支撑,更是实现法律硕士研究生培养目标的必要举措。数智时代要求法律硕士研究生特色课程体系建设须强化职业伦理课程地位,突出“法律+技术”融合式课程设计,注重大数据和信息检索等未来学习能力的培养,强化法律实务教学,完善职业技能教育。然而,当前我国法律硕士研究生课程体系设置一定程度上仍存在应用型特色不明显、实务课程落实不到位、实务师资队伍薄弱等问题。数智时代法律硕士研究生课程体系的建构须遵循以行业需求为导向的课程目标,强化以职业能力培养为核心的课程支撑,构建以结果为导向的课程考核标准。建立以学生职业发展和法律职业伦理融合的特色课程观,优化特色课程结构设置体系,规范特色课程管理,落实特色课程保障,以期更好地满足数智时代法治人才高质量培养的需要。

The construction of a characteristic curriculum system is a key measure to improve and guarantee the education quality of postgraduates of Master of Law(hereinafter“ML students”)in the era of digital intelligence.It is not only an important method to support the education of compound legal talentin the era of digital intelligence,but also a necessary measure to achieve the cultivation goal of ML students.The era of digital intelligence requires that the construction of the characteristic curriculum system for ML studentsshouldlay emphasis on the status of professional ethics course(s),highlighting the integrated curriculum design of“law plus technology”,paying attention to the cultivation of future learning ability,such as the Big Data and information retrieval to strengthen legal practice teaching and improve professional education and technical skill training.However,at present,there are still some problems in the curriculum system of ML students in China,such as the unclear application-oriented characteristics,inadequate implementation of practical courses,weak practical teaching staff and so on.In the digital intelligenceera,the construction of the curriculum system for ML studentsshould follow the curriculum objectives oriented by the needs of the industry,strengthen the curriculum support centered on the cultivation of professional capability,and construct a result-oriented curriculum assessment standard.It is important of establishing a characteristic curriculum view based on the integration of students’professional development and legal professional ethics,optimizing the setting system of characteristic curriculum structure,standardizing the management of characteristic curriculum,and implementing the guarantee of characteristic curriculum,so as to better meet the needs of high-quality cultivation of rule of lawtalent in the era of digital intelligence.
