大数据时代老年人个人信息保护研究——以老年人个人信息保护公益诉讼案件为例

随着信息技术的日益更新,侵犯个人信息的案件也与日俱增,这些案件不仅侵犯了个人的信息权,而且会侵犯社会公共利益,为社会带来较严重的负面影响。在个人信息侵权案件中,老年人作为特殊的群体需要引起关注。老年人在应对信息化社会时存在明显的“数字困境”,一方面老年人无法快速适应智能设备的更新换代,另一方面老年人在个人信息安全保障方面防范意识不足。为了助力“智慧养老”,更好地保障老年人权益,有必要通过完善法律规定、建立多元援助制度、强化老年人个人信息安全意识等方式对老年人个人信息进行特殊保护。

With the update of information technology,the infringement of personal information cases are also increasing day by day,these cases not only infringe the right of personal information,but also infringe the social public interest,bring more serious negative impact to the society.In the case of personal information infringement,the elderly as a special group should be concerned.The elderly face an ob⁃vious“digital dilemma”when dealing with the information society.On the one hand,the elderly cannot quickly adapt to the upgrading of smart devices.On the other hand,the elderly lack of awareness in personal information security.In order to help the“smart pension”and better protect the rights and interests of the elderly,it is necessary to improve the legal provisions,establish a diversified assistance system,strengthen the awareness of the elderly personal information security and other ways to carry out special protection of the elderly's personal information.
