“双减”背景下校外教育培训机构的法治化监管路径

The Legalized Supervision Path of Off Campus Education and Training Institutions Under the Background of“Double Reduction”

对校外教育培训机构的监管必须纳入法治轨道。由于当前对校外教育培训机构仍主要依靠政策文件进行专项监管,导致校外教育培训监管主体不清晰、行政执法遇阻等问题,从而引发各类司法纠纷。而单纯依靠市场调节不仅违背教育公共性,更给教育资本化带来空间。基于此,建构了校外培训机构监管的法治化路径,一是出台专项立法并厘清与现有法律的关系;二是协同多元执法主体,创新教育领域综合执法方式;三是充分发挥行业协会的规范引导作用,实现多元共治。

The supervision of off campus education and training institutions must be incorporated into the rule of law track.Due to the current reliance on policy documents for specialized supervision of off campus education and training institutions,issues such as unclear regulatory bodies and obstacles in administrative law enforcement have led to various judicial disputes.Relying solely on market regula⁃tion not only violates the public nature of education,but also brings space for education capitalization.Based on this,a legal path for the supervision of off campus training institutions has been constructed.Firstly,special legislation has been introduced and the relationship with existing laws has been clarified.Secondly,multiple law enforcement entities have been coordinated to innovate comprehensive law enforcement methods in the field of education.Thirdly,the regulatory and guiding role of industry associations has been fully utilized to achieve diversified co governance.
