“三位一体”黑土地法律保护的应然逻辑与实现路径

Normative logic and implementation of the“three aspects in one”legal protection of the black soil land

中国黑土地总量减少、质量下降、生态功能退化已然危及到国家粮食安全。本文旨在明确黑土地法律保护的应然逻辑,构建严密的黑土地法律保护格局和实现路径,通过“良法善治”,破解“三位一体”黑土地法律保护困境,这一点对于牢牢守住十八亿亩耕地、全方位夯实国家粮食安全根基具有重要意义。整体系统观与“三位一体”黑土地法律保护相契合,因此,以整体系统观为引领是黑土地法律保护建设的应然逻辑;黑土地保护既要有法可依,又要有章可循,更要强化监管,布局“三位一体”黑土地保护的法治形态,应遵循“促立法、重实施、强监督”的逻辑,既要从立法层面规范黑土地保护,更要从法律实施与监督方面做好防控与规制。总之,粮食安全是黑土地法律保护的逻辑起点,黑土地法律保护要以数量、质量、生态“三位一体”保护为核心,坚持走法治化之路。“政府主导、多元参与、以法促治、强化监管”的黑土地保护格局是促进黑土地良性发展,确保国家粮食安全的有效途径。在推进黑土地保护法治建设中,各级政府应积极主导,规范有序地推进黑土地保护法律法规的落地实施,全方位监督其有效运行;同时,政府要鼓励多元主体参与,形成黑土地保护合力,促进黑土地良性发展,实现国家粮食安全。

The decrease of the total amount and quality and degeneration of the ecological function of the black soil land in China has affected the grain output and national food security.The purpose of this study was to clarify the normative logic of the legal protection of the black soil land,build a strict legal protection model of the black soil land and explore its implementation,and solve the dilemma of the“three aspects in one”legal protection of the black soil land through good law and good governance,which is of great significance for firmly safeguarding the arable land of China and consolidating the foundation of national food security.As it exists compatibility between the overall system view and the“three aspects in one”legal protection of the black soil land,taking the overall system view as the logical direction is the normative logic of black soil land legal protection.The legal protection of black soil land should have laws to abide,have regulations to follow,and be strengthened by supervision and management.Formulating the rule of law of the“three aspects in one”black soil land protection should follow the logical structure of“promoting legislation,emphasizing implementation,and strengthening supervision”,which should not only rely on the regular legal system from the legislative level to regulate,but also form a strict legal implementation system and supervision system to fulfill prevention,control and regulation for protection.All in all,food security is the logical starting point of the legal protection of the black soil land,which should focus on the“three aspects in one”protection of quantity,quality,and ecology,and adhere to the route of rule of law.Leading by the government,encouraging all sectors of society to participate in protection,promoting governance by obeying the law,and strengthening supervision and management of the legal protection of the black soil land are an effective way to promote the healthy development of the black soil land and ensure national food security.In the practice of promoting legal constrcution of black soil land,the government at all levels must actively lead,promote regularly and orderly the enforcement of law and regulation of black soil land protection and comprehensively supervise its effective operation.Meanwhile,the government should encourage all sectors of society to take part in protecting the black soil land so as to form a joint force of protection.Thus,it will promote the benign development of black soil land and fulfill the national food security.
