动态隐患清零视域下的刑事羁押人权保障研究

Research on Human Rights Protection in Criminal Custody from the Perspective of Dynamic Clearance of Concealed Risks

人权是社会发展与文明进步的重要标志,坚持走人权发展道路是党的二十大报告强调的重要内容。刑事司法领域是公权力与私权利冲突较为集中的领域。看守所是服务刑事诉讼进程的刑事羁押场所,同时也是司法人权保障的重要阵地。鉴于刑事羁押人权保障的社会驱动性、执法市域性、热点敏感性、风险外溢性,在动态隐患清零现实情势下,应当分析被监管人员健康权、辩护权、基本生活权益、民事权益保障等方面的风险,并且探究服务诉讼与人权保障、公平正义与执法效率、法律效果与社会效果统一视角下的被监管人员人权保障的理念、方法与实现路径。

As human rights are an important symbol of social development and civilization progress,adherence to the human rights development is an important content emphasized by the 20th CPC National Congress.The sector of criminal justice is the essential field of conflicts between public power and private right.As a place of criminal detention serving the criminal proceedings,a detention center is the important place of judicial human rights protection.Given the society-driven human rights protection in criminal custody,regional protection,hot spot sensitivity,and risk outspreading,also in the realistic situation of dynamic clearance of concealed risks,it is necessary to analyze potential risks related with the detainees’health rights,defence rights and basic living rights,and civil rights protection and explore the concept or methodology of how to serve proceedings,protect human rights,display fairness and justice,law enforcement efficiency,legal effects and social effects.
