摘要
历史上,一个强大的国家通常也是一个法律大国。以往的法律大国一般都有自己比较完备的法律制度,能对他国法律制度产生重要影响,并且能够引导国际法规则的创设。中国已经具备了比较完备的法治体系,但对他国法律的影响比较有限,在主导国际法规则的创设方面也不及某些西方大国。然而,基于中国的国家性质、传统文化和法治特色,中国并不刻意追求对他国法律制度的影响,也没有单方主导国际法规则创设的意愿,因此,是否具有传统的法律大国的特征不足以评判中国是否已具备法律大国地位;而能否持续推进国内法治建设,以及能否在西方的制度打压下保持住自己的基本制度并在世界范围内实现多种制度的共存应成为衡量中国是否具备法律大国地位的现实标准。
Historically,a country with great power is usually the one with great legal power.And a great legal power was used to seriously influence the legal system of other countries with its relatively complete legal system,and direct the establishment of international rules.Although has a relative complete system of rule of law,China has a rather limited impact on the laws of other countries,and makes less contributions to leading foundation of international rules than some western powers.However,due to its nature of state,traditional culture and characteristics of rule law,China neither purposefully pursue its impacts on legal systems of other countries,nor has the willingness to unilaterally dominate the establishment of international rules.Therefore,it is not sufficient to make a judgement over whether or not China has attained the status of great legal power based upon the characteristics of traditional legal power.And the realistic standards measured about whether China has attained the status of great legal power should be,the capability of continuing progressing the domestic construction of rule of law,and the capability of maintaining its fundamental regime under the institutional suppressions of the westerns,and achieving the coexistence of multiple systems all over the world.
