仲裁数据化是数字技术广泛应用的时代趋势,其既是仲裁基于效益提升、制度趋同和增强治理能力等需求作出的选择,也得益于各国和仲裁机构在仲裁跨域竞争中为博取优势而作出的努力。数据化导致仲裁需要面对数据监管,由此对仲裁公私界限划分、价值取向平衡和竞争格局调整产生影响。对此,中国应以包容立法的理念在设定宏观仲裁法律框架的基础上,借助地方仲裁立法和参与国际软法制定等方式为仲裁数据化创造空间。以智慧司法的方式通过数据化手段促进诉讼与仲裁的衔接并提升仲裁的解纷能力。以合作监管的模式推动政府、仲裁协会和仲裁机构多元合作,遵循市场化和国际化理顺监管机制,围绕数据的安全、自由流动,以数据分级分类和协议化规范仲裁数据的跨境流动。

The datafication of arbitration is the trend of the times with the widespread use of digital technology.It is the choice made by arbitration based on the demands for efficiency escalation,institutions convergence and governance enhancement;it also benefits from the efforts of countries and arbitration institutions to gain an advantage in the cross-territory competition in arbitration.The data-based approach has led to the need for arbitration to face data regulation,which has implications for the delineation of the publicprivate boundary of arbitration,the balance of values and the adjustment of the competitive landscape.In this regard,China should create space for the datafication of arbitration by means of inclusive legislation,based on a macro-legal framework for arbitration,local arbitration legislation and participation in the development of international soft law.In the form of smart justice,the data-based approach should facilitate the interface between litigation and arbitration and enhance arbitration's ability to resolve disputes.The cooperation among the government,arbitration associations and arbitration institutions is promoted through a cooperative regulatory model,the regulatory mechanism is rationalized around marketisation and internationalization,and the cross-border flow of arbitration data is ensured through data classification and agreement around data security and freedom.
