权利物权是权利上的权利之典型,而非全部。担保物权的客体担保财产指向财产权;物的交换价值同样指向财产权;物的担保权益超过用益物权之担保权益,物的担保实为物之所有权担保;实体思维是所有权担保隐形的原因。担保物权的命名和归属有违逻辑规则。担保物权的客体是真正之物权(所有权、用益物权)、知识产权、债权、股权等财产权,其是该等权利的共同面向,其本质是权利上的权利,功能上为担保权,其地位不亚于物权,并独立于物权。

Rights in rem are typical rights of right but not all.The object of security rights in rem is property right,and the exchange value of things also points to property right.The security interest of things exceed those of usufructuary right and the security of things is actually the security of ownership.Concrete thinking is the reason why the security of ownership is invisible.The naming and attribution of security rights in rem violates logical rules.The objects of security rights in rem are genuine rights in rem(ownership,usufructuary right),intellectual property rights,creditor’s rights and shareholders’rights.Right as the object is the common aspect of these rights.In essence,they are rights of right.Functionally,they are security rights and their status are no less than rights in rem and are independent of rights in rem.
