Research on the Evidential Burden in the Process of Patent Examination

【目的】从举证的原则出发,探讨专利审查过程中举证责任分配的问题。【方法】分析对不同类型专利的审查流程和有关法律法规及常见的审查过程如新颖性、创造性审查过程中举证责任的合理分配等问题。【结果】应根据不同类型专利的具体情况,综合考虑举证的责任、必要性及难易程度,制定合理的举证责任分配方案。【结论】举证责任的分配是动态变化的,审查过程可以结合举证过程中需要遵循的原则,对具体情况进行具体分析,厘清其中的举证的必要性、举证责任和举证难度,明确相应的举证责任分配问题。

[Purposes]This study aims to explore the issue of the allocation of burden of proof in patent examination process.[Methods]Starting from the principles of burden of proof,it analyzes the reasonable distribution of burden of proof in common examination processes such as novelty and inventive step examination,and preliminarily analyzes the dynamic changes in burden of proof in the examination process.This article draws on the provisions of other laws,comprehensively considering the responsibility,necessity,and difficulty of burden of proof from some principles of burden of proof.Specifically,the author analyzes the examination process of different types of patents and relevant laws and regulations,reveals the problem of burden of proof allocation in the patent examination process,and proposes improvement measures from multiple perspectives.[Findings]In the examination process,a reasonable burden of proof allocation plan should be formulated based on the specific circumstances of different types of patents affter comprehensively considering the responsibility,necessity,and difficulty of burden of proof.[Conclusions]The allocation of burden of proof is dynamic and can be analyzed specifically according to the principles that need to be followed in the burden of proof process,clarifying the necessity,responsibility and difficulty of burden of proof,and clearly defining the corresponding burden of proof allocation issues.
