摘要
联营律师事务所历经了从合同型联营试点探索到司法部将合伙型联营推广至全国范围的过程,但其目前仍处于复制推广摸索前进的阶段,合伙型联营律师事务所接收实习人员的实习,也处于初步阶段,相关实习规则也有不足。在实践中,原有实习规则的规定限制与现实发展需求之间发生了冲突与挑战,此外,粤港澳大湾区律师制度试点的引入和开展,也令原有规则的不适应问题进一步放大,在此背景下,重新审视目前实施的联营律师事务所实习人员管理制度,对制定联营律师事务所实习管理的专门规定、实习规则修改、实习训练项目的规范化、法律法规和规则的衔接、联营律师事务所实习制度的理论研究方面提出修改和完善的建议,为联营律师事务所实习管理工作的进一步开展提供探索路径。
Associate law firms have gone through the process of exploring from the pilot exploration of contract joint ventures to the promotion of partnership joint ventures to the whole country by the Ministry of Justice,but they are still in the stage of replication and promotion,and the internships accepted by partnership law firms are also in the preliminary stage,and the relevant internship rules are also insufficient.In practice,conflicts and challenges have arisen between the restrictions of the original internship rules and the actual development needs,in addition,the introduction and development of the pilot lawyer system in the Guangdong-Hong Kong-Macao Greater Bay Area has further amplified the problem of incompatibility of the original rules.In terms of theoretical research on the internship system of associated law firms,suggestions for revision and improvement are put forward,which provides an exploration path for the further development of internship management of associated law firms.
