The Legal Connotation of“Integrity”Value and Its Institutional Practice

现代社会的诚信,以新的经济社会状态为基础构建了新型道德诚信、经济诚信和制度(法律)诚信等多重维度的内涵。“诚信”价值与现代法治的社会运行机理具有内在的一致性。“诚信”价值入法是私法自治丰富完善的体现,其以法律原则和法律规则两种路径或形式体现在我国《民法典》和民商事单行法规范之中。“诚信”价值的公法制度实践以社会契约论、责任政府理论和法的内在道德为其证成的逻辑基础,并在宪法领域、行政法治领域、司法公信建设领域和刑事法治建设领域获得了体系性的表达。

The integrity of modern society,based on the new economic and social status,constructs the multi-dimensional connotation of new moral integrity,economic integrity and institutional(legal)integrity.The value of“integrity”is intrinsically consistent with the social operating mechanism of modern rule of law.Value of“good faith”is the embodiment of rich and perfect private law autonomy,which is reflected in two ways or forms of legal principles and legal rules in China’s Civil Code and specific regulations of civil and commercial law.The public law system practice of“good faith”value is based on the theory of social contract,the theory of responsible government and the inherent morality of law,and has been systematically expressed in the fields of constitution,administrative rule of law,judicial trust construction and criminal rule of law construction.
