跨境电商物流的法律风险及治理路径

On the Legal Risks and Governance Paths of Cross-Border E-Commerce Logistics

当前,随着跨境电商的快速发展,跨境电商物流顺势而生,引起了公众的广泛关注。对此,文章概述跨境电商物流的基本模式,阐明现有国内外相关法律法规、法律原则;对跨境电商物流中的法律风险进行分析得知,当前跨境电商物流行业存在物流法律体系松散庞杂、跨境电商物流的合同性质不够明确、管理者或员工法律素养较低的问题。为了有效防范跨境电商物流的法律风险,文章提出了相关治理路径,即健全跨境电商物流法律制度,明确跨境电商物流的合同性质,提高管理者和员工的法律素养以及完善物流监管冲突协调机制。

At present,with the rapid development of cross-border e-commerce,cross-border e-commerce logistics is born along with the trend,which has also attracted widespread attention from the public.In this regard,the paper outlines the basic model of cross-border e-commerce logistics,clarifies the existing domestic and foreign relevant laws,regulations,and the legal principles.Analyzing the legal risks in cross-border e-commerce logistics,it is found that there are currently problems in the cross-border e-commerce logistics industry,such as a loose and complex logistics legal system,unclear nature of cross-border e-commerce logistic contracts,and low legal literacy of managers or employees.In order to effectively prevent legal risks of cross-border e-commerce logistics,relevant governance paths are proposed,to improve the legal system of cross-border e-commerce logistics,clarify the nature of cross-border e-commerce logistics contract,enhance the legal quality of managers and employees,and improve the coordination mechanism of logistics regulatory conflicts.
