第三方物流是物联网时代现代物流行业发展的必然趋势,其优势显著,但由于第三方物流相关配套机制与法律规范存在缺失,因此第三方物流运输不可避免会面临诸多侵权风险。鉴于此,文章有必要基于第三方物流合同订立双方利益平衡视角厘清第三方物流存在的法律风险类型,完善我国第三方物流法律制度,并构建第三方物流风险规避机制。

The third-party logistics is the inevitable trend of the development of modern logistics industry in the era of the Internet of Things,with significant advantages.However,due to lack of supporting mechanisms and legal norms related to thirdparty logistics,third-party logistics transportation will inevitably face many infringement risks.In view of this,it is necessary to proceed from the perspective of balance of interests between the parties to the third-party logistics contract,clarify the types of legal risks existing in the third party logistics,perfect the legal system of the third party logistics,and construct the risk avoidance mechanism of the third party logistics.
