Discussion on Compensation for Regular Drainage of Dam Foundation Pit in Hydropower Project

水电工程大坝基坑经常性排水,包括了堰体及堰基的渗漏水、由于汛期基坑过流而造成的基坑积水、由于降雨而造成的基坑积水、施工过程中的废水(包括坝体混凝土施工积水、帷幕灌浆、固结灌浆及基岩排水孔施工废水、坡面汇水、其他可能进入本合同工作范围的施工废水)。经常性排水一般在招标文件均为总价承包,承包人根据发包人提供的地质条件进行分析判断并报价。但在实施过程中,若发生非承包人原因,实际基坑抽排水量与投标发生根本变化,导致有经验的承包人无法预见。文章首先分析基坑抽排水增加的原因,确定责任归属;其次从法律、法规方面分析基坑抽排水补偿的法律依据,从招标投标文件等方面分析基坑抽排水补偿的合同依据;最后提出几种基坑抽排水补偿方案,并且分析探讨各自的优缺点,提出建议。

The regular drainage of the dam foundation pit of the hydropower project includes the leakage water of the weir body and the weir foundation,the water accumulated in the foundation pit due to the overflow of the foundation pit in the flood season,the water accumulated in the foundation pit due to rainfall,the waste water in the construction process(including the water accumulated in the dam concrete construction,curtain grouting,consolidation grouting and bedrock drainage hole construction waste water,slope catchment,and other construction waste water that may enter the scope of work of this contract).Generally,the bidding documents are all lump sum contracts.The contractor shall analyze,judge and quote according to the geological conditions provided by the employer.However,in the process of implementation,if the actual foundation pit pumping and drainage volume changes fundamentally with the bidding due to reasons other than the contractor,the experienced contractor cannot predict.This paper first analyzes the reasons for the increase of foundation pit pumping and drainage,and determines the responsibility attribution;secondly,analyze the legal basis of foundation pit compensation pumping and drainage from the perspective of laws and regulations,and analyze the contract basis of foundation pit pumping and drainage compensation from the perspective of bidding documents;finally,the author puts forward several compensation schemes for foundation pit pumping and drainage,analyzes their advantages and disadvantages,and puts forward the author's suggestions.
