论行政规范性文件的公布

On the Publication of Administrative Normative Document

行政规范性文件,是政府管理服务社会的重要规制工具。行政规范性文件的公布是一项基本法治原则,也是常识。但是,从实际情况考察,对于行政规范性文件为什么要公布的问题,现有研究很不够,大众认识很不到位,由此,行政规范性文件公布的实际做法不够规范,不知道制发过多少文件、不知道现行有效多少文件、不知道从何获取全部现行有效文件的问题普遍存在。回顾历史并放眼世界,一个基本结论是,行政规范性文件公布的目的在于执行。要立足这一根本目的,全面规范行政规范性文件公布,逐步实现行政规范性文件的依法授权、统一公布、动态更新、有效管理。

Administrative normative document is important regulatory tool for government to manage and serve the society.It is a basic rule of law and common sense that administrative regulatory document should be published.However,according to the actual situation,the research and understanding of why administrative normative document should be published are not enough,therefore,the actual practice of promulgation of administrative normative documents is very irregular,the problem of not knowing how many documents have been produced and issued,not knowing how many documents are currently effective,and not knowing how to obtain all the current effective documents is widespread.Looking back at history and looking around the world,a basic conclusion is that the purpose of publishing administrative normative document is to implement them.Based on this fundamental purpose,we should comprehensively standardize the publication of administrative normative documents,and gradually realize the legal authorization,unified publication,dynamic update and effective management of administrative normative documents.
