刑事诉讼非羁押数字化监控的实证研究

非羁押数字监控措施是在我国审前羁押率高、审前风险难以控制的基础上,保障被监控者人身自由和人格尊严的前提下融合数字化技术提出的新型监控措施。文章考察非羁押数字监控措施的理论基础和实践现状,深入分析非羁押数字监控措施落实和适用的障碍,并对其制度化设计进行规划与展望,以期非羁押数字监控真正得到推进和发展,进一步降低我国审前羁押率,维护犯罪嫌疑人与被告人的权利,促进刑事诉讼程序顺利进行。

Non-detention digital monitoring measures are new monitoring measures of digital technology on the basis of the high rate of pre-trial detention and the risks are difficult to control under the premise of ensuring the personal freedom and personality dignity of the monitored.This paper will investigate the theoretical basis and practical status of non-custodial digital monitoring measures,in-depth analysis of the implementation and application of non-custodial digital monitoring measures obstacles,and its institutionalized design planning and prospects,in order to promote and develop non-custodial digital monitoring,further reduce the rate of pre-trial detention,safeguard the rights of suspects and defendants,facilitate the smooth running of criminal proceedings.
