摘要
本文采用实证研究和比较研究的方法,以“人民法院在线服务”为例,探讨在线诉讼平台规则的完善;通过系统梳理,检视“人民法院在线服务”现有平台中用户服务协议、隐私规则、平台规则展示等规则的不足;从功能主义的角度出发,基于用户调研,参考国内政务服务类平台规则整体情况和共性,提出了在线诉讼平台的特殊属性理论,即信息服务平台和案件办理平台的二象性、平台建设单位和案件办理单位的重合性;对“人民法院在线服务”提出包括制定用户服务协议、强化权利义务告知、提升规则触达能力等方面的具体建议,希冀有益于在线诉讼平台规则之完善。
This paper uses the methods of empirical research and comparative research,tak-ing“people's court online service”as an example,to explore the improvement of online litigation platform rules.Through systematic review,the paper examines the shortcomings of the existing platform of“People's Court Online Service”,such as the lack of user service agreements,unreal-istic privacy rules and poor presentation of platform rules.From the perspective of functionalism,based on the users survey and the overall situation and common issues of the existing domestic government service platform rules,this paper puts forward the special attribute theory of online lit-igation platform,i.e.the duality of information service platform and case handling platform,and the coincidence of platform construction unit and case handling unit.It further makes specific sug-gestions on the“People's Court Online Service”,including formulating user service agreements,strengthening the notification of rights and obligations,and enhancing access to the rules,so that it may benefit the improvement of online litigation platform rules.
