Research on the Reform of the Technical Regulation of Mandatory National Standards

强制性标准是我国标准体系的重要类型,随着标准化体制改革和立法完善,强制性国家标准正在进行技术法规化变革。因此,探讨国内外关于强制性标准属性的争议,分析我国强制性国家标准技术法规化变革的外在表达,以及强制性国家标准不是技术法规的内在原由。结合我国相关领域强制性国家标准改革实践,应进一步明晰标准与法律之界限,建立健全标准与法律协调配套机制。

Mandatory standards is an important type of Chinese standard system,along with the standardization system reform and legislative improvement,mandatory national standards is carrying out the reform of technical regulation.Therefore,to discuss the dispute about mandatory standards attribute at home and abroad,analyze the external expression of the reform of mandatory national standards technical rule,and the essential reason why mandatory national standards is not technical regulation.According to the practice of mandatory national standards reform in related fields,the limit of standard and law should be further clarified,and the supporting mechanism of coordination between standard and law should be established.
