算法时代网络平台版权过滤义务构建

传统“避风港”体系下网络平台的版权责任认定规则难以抵挡算法技术的系统性冲击,确有必要构建以事前治理为导向的版权过滤责任体系。利益平衡的坚守、经济效益的追求、制度建设的推动、过滤技术的发展也同时增强了版权过滤机制的可行性。应以比例原则找寻版权保护与言论自由的平衡点;秉持审慎适用的态度构建“版权过滤协议”自治规则,通过二元审查模式界定过滤范围,在类型化标准下采用“相对比例”设置过滤标准,同时健全反通知机制对错误过滤的权利施加救济。持续提高网络服务提供者的版权注意义务,对算法技术发起的挑战作出理性回应。

The copyright liability determination rules of online platforms under the traditional“safe harbor”system cannot withstand the systematic impact of algorithm technology,and it is indeed necessary to build a copyright filtering liability system oriented by prior review.The adherence to the balance of interests,the pursuit of economic benefits,the promotion of system construction,and the development of filtering technology have also enhanced the feasibility of the copyright filtering mechanism.The principle of proportionality should be used to find the balance between copyright protection and freedom of speech;the autonomous rules of the“copyright filtering agreement”should be established with a prudent and applicable attitude,the filtering scope should be defined through the dual review mode,and the filtering standard should be set using“relative proportion”under the type standard,while sound counter-notification mechanisms impose remedies for false filtering rights.It is required to continuously promote the copyright responsibilities of network service providers to a higher duty of care,and to rationally respond to the challenges initiated by algorithm technology.
