新时代高校法治建设率先突破路径研究——从行政法视角分析

A Study on the First Breakthrough Path in the Construction of University Rule of Law in the New Era:From the Perspective of Administrative Law

鉴于依法办学、依法治校、依法治教是新时代高等学校治理的基本理念和基本方式,也是新时代法治国家、法治政府、法治社会建设的必然要求,从行政法角度分析,高校作为公务法人,新时代高校法治建设是法治政府建设的组成部分,高校法治建设要率先突破,对法治政府起到示范和引领作用,而高校法治建设率先突破的实现存在困境,针对困境探索出高校法治建设率先突破的实践路径。

Running managing by law,teaching by law are the basic concepts and methods of college and university management in the new era.They are also the inevitable requirement of the construction of the country,government and society under the rule of law in the new era.From the perspective of administrative law,the construction of the rule of law in universities in the new era is a part of the law-based government construction.The construction of the rule of law in universities takes the lead in the breakthrough,and will play an exemplary and leading role to the law-based government.Focusing on the difficulties of realization,this paper puts forward the practical path.
