城市居住小区体育场地设施有效供给的法律规制——基于新修订的《中华人民共和国体育法》第83条的思考

A Study on Legal Regulation on Effective Supply of Sports Facilities in Urban Residential Areas——Reflections based on Article 83 of the the Newly Revised Sports Law of China

研究以城市居住小区体育场地设施有效供给的法律规制为研究对象,运用文献研究法、比较分析法等方法,对新修订的《中华人民共和国体育法》第83条有关居民健身体育场地设施的建设和配置进行了评析;同时,梳理了体育行政部门颁布的有关规定,比照城市建筑规划相对应的条款,认为:城市居住小区体育用地法规正当性缺失是导致城市居住小区体育用地供给失衡的主要原因。最后,从存量与增量两个供给路径出发,建议在修改完善《全民健身条例》中,针对居住小区配套体育场地设施建设提出三条具体规定:城市规划人均体育用地参照标准;规划“红线”确定新建居住小区预留用地;老旧小区闲置空间(地)体育功能性改造后纳入体育用地统计,力图为进一步有效落实新修订的《体育法》相关法条精神,保障公民平等地享受体育公共服务,实现体育公共服务均等化。

Taking the legal regulation of the effective supply of sports venues in urban residential areas as the research object,the article 83 of the newly revised Sports Law of the People's Republic of China concerning the construction and configuration of residents'fitness sports venues and facilities was evaluated and analyzed by the methods of literature research and comparative analysis.At the same time,it combs the relevant regulations issued by the sports administrative department,and compares with the corresponding provisions of urban architectural planning,and holds that:the lack of legitimacy of the sports land regulations in urban residential quarters is the main reason leading to the imbalance of sports land supply in urban residential community.At last,starting from the two supply paths of stock and increment,it is suggested to put forward three specific provisions for the construction of supporting sports venues in residential areas in the amendment and improvement of"Regulations on National Fitness":reference standard of per capita sports land in urban planning;Planning"red line"to determine the reserved land for new residential communities;Idle space(land)in old residential areas is included in sports land statistics after functional transformation,in order to further effectively implement the spirit of relevant laws and regulations of the newly revised"Sports Law",guarantee citizens to enjoy sports public services equally,and realize the equality of sports public services.
