The Influence and Response of The Notification Commitment System on Administrative Licensing

在“放管服”改革中,告知承诺制逐渐成为一种高频使用的新型行政许可方式,其实践运作借助社会信用体系中的信用信息和失信联合惩戒措施,实现了从事前控制到事后监管的转型。告知承诺制已经对我国行政许可的理念、价值和规则产生了结构性影响:在理念上,引入合作、信任与激励的要素;在价值上,调整了行政许可价值追求的排列次序,重塑了行政效率原则的内涵,确立了辅助性原则、合作性原则;在规则上,更新了许可的实体规则,改变了许可的程序规定。面对挑战,《行政许可法》势必要做出及时回应,这就需从回归利益均衡、确定适用范围、设置简易程序和健全法律责任四个方面,对告知承诺制改革予以合法性承认,为其推广实施量身定制法律依据。

In the process of the reform of“decentralization,regulation and service”,the notification commitment system has gradually become a new type of administrative licensing method with high frequency.And the operation of the notification commitment system has realized the transformation from pre-control to post-supervision by means of credit information and joint disciplinary measures for dishonesty in the social credit system.The notification commitment system has had a profound structural impact on the concept,value and rules of administrative licensing in China:in the concept of governance,the elements of cooperation,trust and incentive are introduced;in terms of value,it not only adjusts the order of value pursuit of administrative licensing,but also reshapes the connotation of administrative efficiency principle,and embeds two new principles of auxiliary principle and cooperative principle;in the implementation of the rules,it has not only updated the licensing entity rules,but also has changed the licensing procedures.Facing the challenge,the“Administrative Licensing Law”should make the necessary responses to the evolution brought about by the notification commitment system.This requires a return to the balance of interests,the determination of the scope of application,the establishment of summary procedures and the improvement of legal responsibilities,and the legitimacy of the notification commitment system reform.And it is necessary to recognize the legitimacy of the reform of the notification commitment system,and to make a legal basis for its comprehensive promotion and implementation.
